This policy sets out the basis on which any personal information we collect from you, or that you provide to us, will be processed by us. We process your personal information to run our business and provide our users with the services. Please read the following carefully to understand our views and practices regarding your personal information and how we will treat it. If you don’t want us to collect or process your personal information in the ways described in this policy, you shouldn’t use the EDGE Marketplace services. 

Eco Design Growth Environment Limited is the controller and responsible for your personal data (collectively referred to as “EDGE Marketplace”, “we”, “us” or “our” in this privacy policy). 

By using the services, you acknowledge that EDGE Marketplace will use your information in the United Kingdom where EDGE Marketplace is located. Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside. 

  1. Information Collected or Received

We may collect, use, store and transfer different kinds of personal information about you, including:

  • Identity Data, such as first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender.
  • Contact Data, such as your billing address, delivery address, email address and telephone numbers,
  • Financial Data, such as bank account and payment card details,
  • Transaction Data, including details about payments to and from you, and other details of products and services you purchase from us,
  • Technical Data, including internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access our website.   • Profile Data, such as your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses,
  • Usage Data, including information about how you use our website, products and services, and
  • Marketing Data, such as your preferences in receiving marketing from us and our third parties, and your communication preferences. 

As part of the collection of Technical Data, we obtain location information you provide in your profile or your IP address. With your consent, we may also determine location by using other information from your device, such as precise location information from GPS or information about wireless networks or cell towers near your mobile device. If you have consented to share your precise device location details but would no longer like to continue sharing that information with us, you may revoke your consent to the sharing of that information through the settings on your mobile device. Certain non-precise location services, such as for security and localised policies based on your IP address or submitted address, are critical for the Site to function.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

In the course of providing our services, we collect or receive your personal information in a few different ways. We obtain the categories of personal information listed below from the following sources: 

  • directly from you – for example: from forms you complete or during registration; when you place orders on our website, when you request marketing information to be sent to you; if you enter a competition, promotion or survey organised by us; corresponding with us by phone, email or otherwise;
  • indirectly from you using cookies, server logs and other similar technologies based on your activity and interaction with our Services, or from the device or browser you use to access the Services;
  • from our subcontractors/suppliers that help provide EDGE Marketplace services you may interact with (such as, for payments). Our suppliers include Stripe, Paypal, ApplePay and Googlepay;
  • third parties or publicly-available sources such as:
    • analytics providers (such as Google),
    • search information providers
    • providers of technical, payment and delivery services,
    • Dokan.

Often, you choose what information to provide, but sometimes we require certain information to provide you the services. Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time. EDGE Marketplace uses the personal information it receives and collects in accordance with the purposes described in this policy.

  1. How your data will be used

Registration, Account Setup, Service Usage:  EDGE Marketplace will use your identity, contact and financial data to register you as a new customer, register you as a seller, if you set up an account to process your order (including managing payments, fees and charges) and provide you with the services. Processing your data for these purposes shall be necessary to enable us to perform a contract with you. 

Updates: EDGE Marketplace will process your data to notify you about changes to our Terms of Use or this privacy policy. It will be necessary for the performance of the contract between you and us and for our legitimate business interests, namely to ensure you are aware of our current terms and conditions

Website: EDGE Marketplace will use your data to:

  • administer our website and for internal operations, including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting data, research, statistical and survey purposes, to allow you to participate in interactive features of our service, when you choose to do so, to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you and to make suggestions and recommendations to you and other users of our website about goods or services that may interest you or them. It will be necessary for our legitimate business interests to ensure you receive the best experience possible when accessing and using our website. It will also be necessary for running our business, provision of administration and IT services, network security, to prevent fraud and in the context of a business reorganisation or group restructuring exercise. We will comply with our cookie policy when processing this information.
  • deliver relevant website content and advertisements to you and measure or understand the effectiveness of the advertising we serve to you. As a core part of our services, we have a legitimate interest in customising your on-site experience to help you search for and discover relevant items and recommended purchases, including using this information to help vendors find the best ways to market and sell their products on EDGE Marketplace. It will be necessary for our legitimate interests, namely to study how customers use our products/services, to develop them, to grow our business and to inform our marketing strategy.
  • use data analytics to improve our website, products/services, marketing, customer relationships and experiences. It will be necessary for our legitimate interests, namely to define types of customers for our products and services, to keep our website updated and relevant, to develop our business and to inform our marketing strategy.

Keeping our Services Safe and Secure: We use your information for safety and security purposes, which can include sharing your information for such purposes, and we do so because it is necessary to pursue our legitimate interests or those of a third party in ensuring the security of our services, preventing harm to individuals or property, or crime, enforcing or defending legal rights, or preventing damage to EDGE Marketplace systems, or those of our users or our partners. This includes enhancing protection of our community against spam, harassment, intellectual property infringement, crime, fraud and security risks of all kinds. We use your information to provide and improve the Services, for billing and payments, for identification and authentication, and for general research and aggregate reporting.

Prize Draws, Competitions and Surveys: EDGE Marketplace will use your data to enable you to participate in a prize draw, competition or complete a survey. It will be necessary for our legitimate business interests, namely to study how customers use our products, to develop them and help grow our business.

Special Offers: EDGE Marketplace will use your data to provide you with information about special offers and other products we sell that are similar to those that you have already received from us. Where you have previously received marketing communications from us, then it will be necessary for our legitimate business interests, namely to ensure you continue to receive communications that you have previously agreed to receive and to develop our products/services and grow our business. In all other cases, we will only do this if you give us your consent

We will only use your personal information for the purpose(s) for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

  1. Sellers

We also collect from and share data with companies that sell items via our website (Sellers) if you purchase goods from them. We will share your Identity Data, Contact Data, Financial Data, Profile Data Usage Data, as well as any personalisation details you’ve provided as part of your order) with a Seller with whom you have placed an order so that they can fulfil and manage your order as part of the sales process we provide under our Customer Terms and Conditions. Any order placed is deemed to be an instruction from you to share your personal data in this way. The Seller will act as an independent data controller, on a stand-alone basis, and process your personal data in accordance with their own policies and security measures. 

We are not responsible for protecting your information when it is under the Seller’s control, but you may exercise against such Seller all of the rights which you would otherwise be able to exercise against us as set out in this Privacy Policy.

When we share your personal data with a Seller, you should be aware of the following:

  • the Seller (name and contact details) will be as identified on our site. You will be able to contact the Seller directly through our website with any questions or concerns;
  • the Seller will process your personal data (including name, address, gender, billing address, email and telephone number as well as any personalisation details if supplied by you) for the purposes identified above, namely to manage your order;
  • In all other respects, the Seller shall be responsible for treating your personal data in accordance with data protection laws.
  1. Disclosures of your personal data

We respect your privacy. EDGE Marketplace will not disclose your name, email address or other personal information to third parties without your consent, except as specified in this policy.

We may share your personal information with the parties set out below:

  • providers of IT and system administration services to our business, including Dropbox, Hubspot and Microsoft Outlook ,
  • our professional advisers (including solicitors, bankers, auditors and insurers),
  • HM Revenue & Customs, the Information Commissioner’s Office, regulators and other authorities who require reporting of processing activities in certain circumstances,
  • analytics and search engine providers that assist us in the improvement and optimisation of our website, 
  • third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal information in the same way as set out in this policy.

We require all third parties to respect the security of your personal information and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal information for their own purposes and only permit them to process your personal information for specified purposes and in accordance with our instructions.

EDGE Marketplace does not have a direct partner relationship with these third parties and their processing of information is subject to their own privacy policies. You should understand the privacy and security practices of any third party before you share information with them.

  1. Messages from EDGE Marketplace

On occasion, EDGE Marketplace will need to contact you. Primarily, these messages are delivered by email. Every account is required to keep a valid email address on file to receive messages. EDGE Marketplace may also contact you by telephone to provide member support or for transaction-related purposes if you request that we call you. You can update your contact preferences in your account settings at any time. When you contact a Seller using EDGE Marketplace, the feature that allows buyers and Sellers to communicate through the services, we may share aggregated information about your use of the services to sellers, for example if you are a frequent purchaser or a new buyer, so they can provide you with better service and so we improve our services across the site.

Some messages from EDGE Marketplace are service-related and necessary for members and guest checkout users. You understand and agree that EDGE Marketplace can send you non-marketing emails, EDGE Marketplace Messages such as those related to transactions, your account, security, or product changes. Examples of service-related messages include an email address confirmation/welcome email when you register your account, notification of an order, modification of key features or functions and correspondence with EDGE Marketplace.

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. 

Promotional offers from us

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing).

You will receive marketing communications from us if you have requested information from us or purchased goods or services from us and you have not opted out of receiving that marketing.

Third-party marketing

We will get your express opt-in consent before we share your personal data with any third party for marketing purposes. 

Opting out

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us at any time. Members can also control which marketing emails or messages they receive from EDGE Marketplace through their account settings.

Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

You can control your privacy settings through the opt-out buttons in your account settings privacy tab, and the “Privacy Settings” link in the footer of most site pages and our homepage. Please note that some changes to your privacy settings may take a few days to take effect.

  1. Security

The security of your personal information is important to us. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and after it is received, for example encryption is used for certain information (such as credit card numbers) using TLS (transport layer security). Unfortunately, no method of transmission over the internet or method of electronic storage is 100% secure. Therefore, while we strive to protect your personal information, we can’t guarantee its absolute security.

Your account information is protected by a password. It is important that you protect against unauthorised access to your account and information by choosing your password carefully and by keeping your password and computer secure, such as by signing out after using the Services. 

All information you provide to us is stored on our secure servers in the United Kingdom. 

We will take all steps reasonably necessary to ensure that your data is treated securely, including taking the following safeguards:

  • PCI DSS standards. We comply with the Payment Card Industry Data Security Standards in relation to debit/credit card payments made on our website.
  • Building entry controls.
  • Secure lockable desks and cupboards. Desks and cupboards are kept locked when not in use if they hold confidential information of any kind.
  • Methods of disposal. Paper documents are disposed of by shredding in a manner that ensures confidentiality.
  • Firewalls.
  • Encryption.
  • Overseas transfers. Whenever we transfer your personal information outside the United Kingdom, we ensure a similar degree of protection is afforded to it by ensuring that we apply appropriate safeguards. We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data. Where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK. Please contact us if you want further information on the specific mechanism used by us when transferring your personal data out of the UK.

If you are concerned about the levels of data security in any of those countries, please let us know and we will endeavour to advise what steps will be taken to protect your data when stored overseas.

EDGE Marketplace will retain your information only for as long as is necessary for the purposes set out in this policy. The length of time that we will store your data will depend on the “legal basis” for why we are using the data as follows:

In addition, EDGE Marketplace sellers may also be required to retain and use your information in order to comply with their own legal obligations.

Please note that closing your account may not free up your email address, username, or shop name (if any) for reuse on a new account. We also retain log files for internal analysis purposes. These log files are generally retained for a brief period of time, except in cases where they are used for site safety and security, to improve site functionality, or we are legally obligated to retain them for longer time periods.

You have various legal rights in relation to the information you give us, or which we collect about you, as follows:

  • You have a right to access the information we hold about you free-of-charge, together with various information about why and how we are using your information, to whom we may have disclosed that information, from where we originally obtained the information and for how long we will use your information.

Please note that we may continue to store your information, or use your information for the purpose of legal proceedings or for protecting the rights of any other person.
  • You have the right to ask us to transmit the information we hold about you to another person or company in a structured, commonly-used and machine-readable format. Please note that this right can only be exercised in certain circumstances and, if you ask us to transmit your information and we are unable to do so, we will explain why not.
  • Where we use/store your information because it is necessary for our legitimate business interests, you have the right to object to us using/storing your information. We will stop using/storing your information unless we can demonstrate why we believe we have a legitimate business interest which overrides your interests, rights and freedoms.
  • Where we use/store your data because you have given us your specific, informed and unambiguous consent, you have the right to withdraw your consent at any time.
  • You have the right to object to us using/storing your information for direct marketing purposes.

No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
